Result: DUI Reduced to Reckless Driving

A Deputy Sheriff witnessed Defendant stopped in a left turn lane for over 11 seconds with no traffic approaching. After seeing this, the Deputy followed Defendant and observed her going 10 miles per hour below the speed limit and eventually make a wide right turn onto a side street. Upon stopping Defendant, the Deputy documented an odor of alcohol, watery bloodshot eyes, and Defendant’s inability to follow instructions for field sobriety exercises. After poorly performing Field Sobriety Exercises, Defendant gave a breath test sample of .11, and .11 respectively. After negotiation with the State and informing them of an impending motion to suppress the stop, JASON MAYBERRY earned a Reckless Driving charge reduction for his client.
