Result: DUI reduced to Reckless Driving

JM was approached by an officer at a gas station where he was seen asleep in his car with vomit outside the door and slightly upon his clothes. Upon the officer making contact with JM, JM told the officer that he drank 2 shots of tequila prior to leaving his daughter’s house warming party. JM was documented to be unsteady on his feet and was unaware as to how long he had been passed out in his vehicle prior to the officer finding him. JM conducted field sobriety exercises and showed several signs of impairment and ultimately was arrested for suspicion of DUI. JM sought the counsel of Jason Mayberry who negotiated a reduced charge of Reckless Driving. JM was ultimately sentenced to 6 months probation, a withhold of adjudication (allows Defendant to have his record sealed), $500 fine, and 50 public service hours.
