Case Results - State vs. DB

Result: VOP facing 6 years in prison negotiated to 1 year of house arrest followed by probation

DB was on active probation for Sale of Cannabis, Possession of Cannabis, and Possession of Paraphernalia. Client was pulled over in Hillsborough County and arrested for with Possession of Cocaine, thereby not only violating his felony probation status, but doing so with yet another drug offense. A violation of probation for a nearly identical crime as the crime leading to probation is the most difficult kind of violation of probation for an attorney to handle successfully. Based on the circumstances, DB was facing 6 years in the Department of Corrections if he was found to have violated his probation in addition to up to 6 years for his new law violation. Jason Mayberry was hired and negotiated with the State Attorney for a plea involving no further incarceration. Mayberry negotiated for his client to receive one year of house arrest, 30 days of in house drug rehabilitation, followed by one year of felony probation.
