RESULT: Client avoids 17.775 months in Prison and has probation reinstated

Client was on probation for two counts of Sale and Delivery of Oxycodone, both second degree felonies punishable by up to 15 years in the Department of Corrections, in addition to one third degree felony count of Possession of a Controlled Substance and one third degree felony count of Possession of Marijuana, both punishable by up to 5 years in the Department of Corrections.  Client had violated drug offender probation in March 2011 and was sentenced to an additional 6 months community control.  Client violated for the second time in September 2011 for Driving While License Suspended and hired Jason Mayberry to handle this violation of probation.  Jason Mayberry was able to get client released on client’s own recognizance at client’s violation of probation arraignment.  Jason Mayberry advised his client to enter an admission to the violation of probation and be forthright with the Judge regarding client’s troubled past.  Upon speaking on behalf of his client, Jason Mayberry was able to not only avoid prison for his client (the State was asking for 17.775 months in the Department of Corrections), but was able to get client back on drug offender probation with no further community control and no further probation conditions.
