Prison for Russian Band “Pussy Riot”

Three members of the Russian punk rock band “Pussy Riot” evidently rioted too hard in a church where they played a song critical of Russian President Vladimir Putin.  Pussy Riot was found guilty of a criminal charge called “hooliganism” after singing the lyrics “mother mary please drive Putin away” at a Russian church.  They have been incarcerated for 5 months during the pendency of their case, all time that will go toward their two year sentence.  The Pussy Rioters defended saying they were singing out of political motives but that defense wasn’t well taken by their trial judge as he felt they were attempting to insult the Orthodox church and undermine public order.

This is an absolute abortion of justice.  The closest charge to this in Florida would be a misdemeanor disorderly conduct charge under Florida Statue 877.03.  That statute states, “Whoever commits such acts as are of a nature to corrupt the public morals, or outrage the sense of public decency, or affect the peace and quiet of persons who may witness them, or engages in brawling or fighting, or engages in such conduct as to constitute a breach of the peace or disorderly conduct, shall be guilty of a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083.  Under modern case law, one has to literally incite a crowd to riot or do an act like screaming “fire” in a theatre.  Criticism of any of our churches or the President won’t cut the mustard for a charge, much less two years in prison.  No doubt this charge, conviction, and prison sentence was a warning shot across the bow to all in Russia that any government criticism on an effective level runs the risk of criminal charge in a kangaroo court.

Any attempt to claim their song’s lyrics actions could incite a riot are utterly ridiculous.  We’ve all known for a while our freedom of speech rights are much more liberal than other countries but this is beyond comprehension.  I don’t know “Pussy Riot” or their music but what is clear is that this is an effort by Putin and his government to quell the free speech of their people.  In essence he’s taking a popular voice out at its knees before they could have an influence on his presidency.  Beyond pathetic.
